How is Elite's BMC Representative Appointed?

Elite itself is a member of the Building Management Committee (BMC). The individual who attends BMC meetings is appointed to represent the Elite Owners Corporation.

Under NSW strata legislation, the representative is appointed by, or selected in accordance with, a special resolution or by-law of the Owners Corporation.

This means the BMC representative is not simply an independent member of the BMC acting in their own capacity — they are there on behalf of Elite.

While acting as Elite’s BMC representative, the representative is effectively taken to be the Owners Corporation for the purposes of the BMC.

What does this mean in practice?

The representative should:

• Represent Elite’s interests at BMC meetings.
• Keep the Elite Strata Committee informed about BMC activities.
• Share relevant BMC information in a timely manner.
• Bring significant upcoming decisions back to Elite where consultation or direction is appropriate.
• Communicate Elite’s concerns and priorities back to the BMC.
• Report on decisions and actions arising from BMC meetings and operational discussions.

The representative therefore acts as a two-way communication link between Elite and the BMC, rather than operating independently of the committee.

How long does the appointment last?

The precise appointment process, term and replacement arrangements should be checked against Elite’s resolutions/by-laws and the ESP Strata Management Statement, as these documents may contain provisions governing how the representative is selected and how the BMC operates.
